Note: This Policy provides information regarding returns for artworks acquired at @ESRAC.ART. Our team is available to assist you via email, WhatsApp, or phone.

1. Full Refund (100%) – “Not as Described” or Authenticity

You are entitled to a 100% refund of the artwork purchase price if the item received is found to be inauthentic or substantially different from its listing.

  • Definition of “Not as Described”: Includes inauthentic artwork, a size variation of more than 5% from the listed dimensions, or a different medium/material than specified.
  • Notification: You must notify @ESRAC.ART of your intent to return as “not as described” within 7 calendar days of receiving the artwork.
  • Return Shipping: In these specific cases, @ESRAC.ART will provide return instructions and cover the return shipping costs.
  • Exclusion: Shipping costs from the original purchase are non-refundable.

2. Partial Refund (20% Restocking Fee) – Change of Mind

If you change your mind after receiving an original artwork, you may request a return within 14 calendar days of receipt (limited to a maximum of 18 days after the invoice date).

  • Deduction: A 20% restocking and handling fee will be deducted from the total purchase amount. This fee covers administrative processing, auditing, and market repositioning costs.
  • Condition: The refund will only be processed after @ESRAC.ART receives the artwork and confirms it is in its original, pristine, and undamaged condition.
  • Return Shipping: For “change of mind” returns, the buyer is solely responsible for all return shipping costs, including professional packaging and mandatory insurance for the full value of the artwork.

3. Digital Certificate Invalidation (Provenance Audit)

For any return (Full or Partial), the Digital Certificate of Authenticity and Ownership associated with the transaction, signed via Gov.br, will be automatically voided in our records.

  • Invalidation Term: To finalize the refund, the buyer must digitally sign the “Certificate Return and Invalidation Term.” This document formalizes the annulment of ownership and the invalidation of the certificate.
  • Market Quote Adjustment: The artwork’s status in our catalog will be reverted from “Private Collection” or “Sold” to the appropriate status, and the transaction history will be updated to reflect the return.
  • No Rights Retained: Continued possession of the digital certificate file after a refund does not confer any right of ownership or authenticity. Using an invalidated certificate is considered a violation of our Terms of Use and may be subject to legal action.

4. Transfer of Responsibility and Refund Processing

  • The refund will be issued via the original payment method within 10 business days after the artwork has been received and inspected by @ESRAC.ART.
  • Any damage incurred during return transit for “Change of Mind” returns is the buyer’s responsibility and may result in the denial of the refund.
