- Authenticity: We have zero tolerance for forgery. Artists guarantee originality; collectors value the verified provenance.
- Respect: Professionalism is mandatory. Harassment or abusive behavior will result in immediate termination of access.
- Confidentiality: Transactional and personal data are protected under our Data Protection Policy and LGPD/GDPR standards.
- Fairness: Bidding and negotiations must be conducted without manipulation or bad faith.
2. Standards for Artists
Artists (including @ESRAC and curated partners) commit to:
- Guarantee Authorship: Ensure every work presented is original and its authorship is undisputed.
- Technical Accuracy: Provide precise descriptions (materials, dimensions, techniques, and condition reports).
- Moral Rights: Respect copyright and the enduring moral rights of all creators.
- Provenance Integrity: Cooperate with the platform to ensure certificates of authenticity and resale royalty records are accurate.
- Professional Delivery: Ensure artworks are packed to museum standards and dispatched as described.
3. Standards for Collectors and Buyers
Buyers and art lovers commit to:
- Serious Engagement: Participate in auctions and negotiations with the intent and capacity to honor commitments.
- Binding Bids: Acknowledge that a winning bid is a legal and ethical commitment to purchase.
- No Manipulation: Abstain from shill bidding, price manipulation, or fraudulent offers.
- Legal Compliance: Adhere to all international laws regarding customs, taxes, and the protection of cultural heritage.
- Respect for Authorship: Acknowledge the artist’s moral rights, including the right to object to any modification or misuse of the work.
4. General Platform Standards
All participants agree to:
- Zero Tolerance: No discrimination, harassment, or hate speech based on race, gender, nationality, religion, disability, or sexual orientation.
- Financial Integrity: Avoid any involvement in fraud, money laundering, or illicit financial activities. @ESRAC.ART reserves the right to request proof of funds or identity for high-value transactions to ensure compliance with auditing standards.
- Privacy Compliance: Respect the data of other members and avoid unauthorized external sharing of internal platform information.
5. Compliance and Enforcement
Breaches of this Code are taken seriously and may result in:
- Formal warnings and notices.
- Temporary suspension from auctions and community features.
- Permanent ban and account termination.
- Legal action and reporting to authorities in cases of fraud or illicit activity.
6. Reporting Violations
