Introduction
Esrac.Art is an international platform operated by César Ramos (Esrac) dedicated to connecting artists and collectors through ethical, transparent, and fair practices. We are committed to fostering an art community based on integrity, authenticity, and mutual respect.
This Code of Ethics applies to all participants of the Esrac.Art ecosystem, including curated artists, collectors, buyers, and art lovers using the platform. By engaging with Esrac.Art, all users agree to adhere to these principles.
1. Core Principles
- Integrity: All interactions on Esrac.Art must be honest, transparent, and respectful.
- Authenticity: Artists guarantee the originality of their works; buyers trust that all listings are accurate and genuine.
- Respect: Mutual respect is mandatory among artists, buyers, collectors, and the platform.
- Confidentiality: Personal, transactional, and contractual data are treated with confidentiality, in line with privacy regulations.
- Fairness: Fair negotiation, bidding, and purchasing processes are fundamental to our marketplace.
2. For Artists (Curated Creators)
Curated artists must agree to:
- Guarantee the authenticity and authorship of the works offered.
- Provide accurate descriptions, including materials, dimensions, dates, techniques, and condition reports.
- Respect copyright and preserve the moral rights associated with their creations.
- Deliver certificates of authenticity with every sale.
- Ensure the artworks are delivered safely, properly packed, and as described.
- Avoid submitting plagiarized, counterfeit, or fraudulent works.
- Maintain professionalism in communication and transactions with buyers.
- Clearly state whether any resale rights (e.g., royalties or droit de suite) apply when applicable.
- Uphold the platform’s standards of quality, ethics, and professionalism.
3. For Buyers, Collectors, and Art Lovers
Buyers and collectors using Esrac.Art commit to:
- Participate in auctions and purchases with honesty and seriousness.
- Respect the bids placed; a winning bid is a binding commitment to purchase.
- Avoid manipulative practices such as shill bidding or false bidding.
- Treat artists, the platform, and other users with respect and professionalism.
- Complete payments in accordance with the platform’s terms and the agreed deadlines.
- Understand and respect the artist’s moral rights (authorship, integrity, and the right to object to modifications or misuses of the work).
- Maintain the confidentiality of any private agreements or discussions with artists or the platform.
- Comply with all applicable laws, including those related to customs, taxes, and cultural heritage protection when purchasing internationally.
4. General Platform Standards
All participants agree to:
- Zero tolerance for discrimination, harassment, hate speech, or abusive behavior based on race, gender, nationality, religion, disability, age, or sexual orientation.
- Respect privacy and comply with data protection laws (GDPR, LGPD, or other relevant laws depending on the jurisdiction).
- Avoid involvement in any form of fraud, money laundering, or illicit financial activity.
- Acknowledge that the platform reserves the right to suspend, restrict, or terminate accounts that violate this Code.
5. Compliance and Enforcement
- Breaches of this Code may result in actions such as:
- Warnings or formal notices.
- Suspension from participating in auctions or listings.
- Permanent ban from the platform.
- Legal action, if applicable.
- Esrac.Art reserves the right to investigate any reported violations confidentially and impartially.
6. Reporting Violations
- Users can report violations of this Code via the official contact channels provided on the website. Messages are received directly by César Ramos.
- Reports are treated confidentially, and whistleblowers are protected from retaliation.
7. Final Provisions
